By accessing our website, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you, the user (“you” or “User”), and Luckycharm Ventures Limited (“we,” “us,” “our,” or “Company”). By accessing or using this website, lussu.mt (“Website”), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any of these terms, you are expressly prohibited from using the Website and must discontinue the use immediately.

1. GENERAL PROVISIONS

  1. This Agreement applies to all Users of the Website, whether registered or otherwise, including but not limited to, browsers, customers, vendors, and contributors of content.
  2. The Company reserves the right, at its sole discretion, to modify, update, or replace any part of this Agreement at any time. Any such changes shall take effect upon their posting
    on the Website. Your continued use of the Website following any such changes constitutes your acceptance of the revised Agreement

2. ELIGIBILITY

  1. By accessing or using the Website, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into this Agreement. The Website is not intended for individuals under the age of 18, and by using the Website, you confirm that you are at least 18 years old.
  2. You agree to comply with all applicable laws, statutes, and regulations in relation to your use of the Website. Any unauthorized use of the Website may result in your access being suspended or terminated.

3. ACCOUNT CREATION AND USER RESPONSIBILITIES

 1. Account Creation Rules:
When creating an account,
you agree not to:

      • use the email or username of another person with the intent to impersonate them;
      • use a name subject to others’ rights without authorization;
      • use an email or username that is offensive or inappropriate; or
      • allow any other party to use your account or password.

You agree to keep your password confidential and to notify the Company immediately of any unauthorized use of your account. You are responsible for all activities under your account, even if such activities were not conducted by you. The Company is not liable for any loss or damage resulting from your failure to maintain the confidentiality of your password.

 

2. Restricted Access for Employees and Affiliates:Employees, directors, managers and/or direct or indirect contractors of Luckycharm Ventures Limited Company, as well as their immediate family members (including parents, spouses, domestic partners, siblings, and children) and any person residing in the same household, are not eligible to participate in or win any giveaways or prize draws offered on the Website.  

4. SERVICES

  1. The Website provides membership-based discounts from various outlets and regular member-oriented initiatives and promotions. The Company reserves the right to alter or discontinue any part of the Website’s services without notice at its sole discretion.
  2. Your use of the services provided through the Website is subject to any additional terms and conditions that may apply to specific services, subscription plans, or promotions

5. MEMBERSHIPS,SUBSCRIPTIONS, AND LOYALTY PROGRAMS

  1. The Company offers various subscription and membership plans. Full details of the terms, benefits, and pricing of these plans are available on the Website.
  2. Auto-renewal: Unless otherwise specified, all subscription plans are automatically renewed at the end of each billing cycle. By subscribing, you authorize the Company to charge the applicable subscription fee using the payment method you have provided.
  3. Cancellation: You may cancel your subscription at any time, by contacting us at contact (at) lussu (dot) mt with the following information:- Full Name, Membership Start Date, Membership ID, Phone Number. Cancellation will take effect at the end of the current billing cycle. No refunds will be issued for any unused portion of the subscription. Refer to 5.7 for more information.
  4. Payment Failures on Subscription Renewal:
    If your payment method fails during the renewal of your subscription, you will be notified and granted a grace period of 1 day to update your payment information. During this grace period, your access to the membership benefits will be temporarily suspended until the payment is successfully processed. If payment is not resolved within the grace period, your membership will be canceled, and access to any paid content or services will be revoked. You will need to re-subscribe and provide a valid payment method to restore access to the services.
  5. Refund Policy: Refunds for services are granted solely at the Company’s discretion, in accordance with applicable consumer laws. All requests for refunds must be submitted to contact (at) lussu (dot) mt and you may find more information about our Refund Policy at the bottom of this page.
  6. Termination of Account and User Responsibilities:
    You acknowledge that you have no ownership rights in your account. The Company may terminate your account and delete all user content associated with it at any time, with or without notice, if you violate these Terms and Conditions or for any other reason. The Company will not be liable for any damages or loss resulting from the termination of your account or removal of any user content.
  7. Membership Cancellation Process:
    To cancel your loyalty membership, please email contact (at) lussu (dot) mt. Upon receiving your cancellation request, the Company will send an email confirmation, after which your direct debit will be canceled with no refund. Access to membership benefits will remain available until the end of the paid period. Canceled subscriptions cannot be reactivated, and any accumulated history related to the subscription will be lost

6. MEMBERSHIP OPTIONS

1. One-Off Memberships: The Company offers several tiers of one-off memberships, each providing time-limited access to the member’s rewards platform aswell as one-time entries into giveaways. These memberships grant access to platform benefits only for the specified duration. 

    • Lussu Exclusive: €5.99 for 7 days of access + 1 entry into 1 giveaway
    • Lussu Top: €11.99 for 7 days of access+ 10 entries into 1 giveaway
    • Lussu Full: €18.99 for 7 days of access+ 30 entries into 1 giveaway 


2. Loyalty Memberships:The Company offers multiple loyalty membership tiers with varying benefits, all of which are renewed monthly:

 

    • Lussu Exclusive Monthly – €10.99/month: Full 30-day access to discounts, automatic entry into all month (4) giveaways with 1 entry per giveaway,  Weekly Bonus entry into  €50 cash giveaway,
    • Lussu Top Monthly – €19.99/month: Full 30-day access to discounts, automatic entry into upcoming 4 giveaways per month with 10 entries per giveaway,  Weekly Bonus entry into  €50 cash giveaway.
    • Lussu Full Monthly – €29.99/month: Full 30-day access to discounts, automatic entry into upcoming 4 giveaways per month with 30 entries per giveaway,   Weekly Bonus entry into  €50 cash giveaway,

7. SALE OF GOODS AND SERVICES

  1. Product Descriptions: While the Company strives to ensure that the information on the Website is accurate, complete, and current, it does not warrant that the descriptions, pricing, or other content available on the Website are error-free.
  2. Pricing: All prices are stated in Euro (€). The Company reserves the right to modify the pricing of goods and services at any time without notice. In the event of an error in pricing, the Company reserves the right to cancel any orders and/or subscriptions affected by such an error.
  3. No Warranty: The Company makes no representations or warranties of any kind, express or implied, regarding the products or prizes obtained through the Website. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. All products or prizes are handed-over to you “as is” and “as available,” without any warranty as to their performance, durability, or suitability for any intended use. Any reliance you place on such information is strictly at your own risk.
  4. Use of Brand Names: Any brand names, trademarks, or logos used on the Website are the property of their respective owners and are displayed solely for the purpose of identifying the products or services being offered. The use of these brand names does not imply any affiliation, sponsorship, or endorsement by the Company, and no proprietary rights are claimed by the Company over these brands.
  5. Products from Shops Offering Discounts: The Company may facilitate access to discounts or promotions offered by third-party shops through the Website. However, the Company is not responsible for any products or services purchased from these third-party shops. Any claims, disputes, or issues related to the products obtained through such discounts are strictly between you and the third-party shop. The Company disclaims all liability in connection with any products or services obtained from these third-party vendors, including any warranties, performance, or suitability for a particular purpose.

8. DATA PROTECTION AND PRIVACY

  1. The Company is committed to protecting your personal data in compliance with the General Data Protection Regulation (EU Regulation 2016/679) (“GDPR”) and applicable Maltese data protection laws.   2. Right to Withdraw Consent: You retain the right to withdraw your consent to the processing of your personal data at any time by contacting us at contact (at) lussu (dot) mt. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
  3. Data Retention: We will retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including compliance with legal obligations, dispute resolution, and enforcement of our agreements.
  4. Data Breach Notification: In the event of a data breach that affects your personal data, we will notify you and the relevant supervisory authorities within the timeframe required under GDPR.

9. USER-GENERATED CONTENT

  1. By submitting any content (such as reviews, comments, or other materials) to the Website, you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, and distribute such content in any and all media.
  2. You represent and warrant that any content submitted by you does not infringe the intellectual property or other rights of any third party and complies with all applicable laws and regulations

10. INTELLECTUAL PROPERTY

  1. All content on the Website, including but not limited to text, graphics, logos, images, and software, is the exclusive property of the Company or its licensors and is protected by intellectual property laws.
  2. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use. You agree not to copy, modify, distribute, or exploit any portion of the Website without prior written consent from the Company

11. PAYMENT TERMS

  1. All payments for goods and services must be made in Euro (€). We accept payments through Stripe. The Company may charge applicable transaction fees for certain payment methods.
  2. Failed Payments: In the event of a failed or declined payment, the Company reserves the right to suspend your access to the services until full payment is made

12. CONSUMER RIGHTS

  1. Memberships and Subscription Services: In accordance with Maltese law, if you purchase a membership or subscription service through the Website, you have the right to cancel your subscription within fourteen (14) days of the date of purchase, provided that you have not accessed any of the paid content, services, or benefits of the membership, including but not limited to, any prize draws that would have taken place during that period. Please note that once you complete the purchase, your account will automatically be granted full access to all membership benefits, including entry into any prize draws conducted during the subscription period. By subscribing, you acknowledge and agree that this immediate access to content and prize draw entry constitutes the full use of the membership benefits. Consequently, if you choose to exercise your right to cancel within the 14-day period, any refunds will be at the Company’s discretion and will only be considered if no prize draws have occurred during your subscription period.
  2. Exceptions to the Right of Withdrawal: Once your membership has been activated, providing you access to all content and entry into active prize draws, you expressly waive your right to withdraw from the contract under the Consumer Rights Regulations (S.L. 378.17) of the Laws of Malta. This waiver applies because access to digital content and prize draw entry is granted upon activation, constituting full usage of the membership benefits. As such, no refunds will be issued following activation of your membership.
  3. Payment Failures on Subscription Renewal:
    If your payment method fails during the renewal of your membership or subscription service, you will be notified to update your payment details. During this grace period, your access to the membership benefits will be suspended until the payment issue is resolved. If payment is not successfully processed within the specified grace period, your membership will be canceled, and you will lose access to all paid content and services. It will be your responsibility to re-subscribe and provide a valid payment method to regain access. A reactivation fee may be applied at the Company’s discretion.
  4. Prize Draws: Participation in any prize draws offered by the Company is automated and included with membership activation. By entering a prize draw, you agree to the terms and conditions specific to that draw. Prize draws are subject to verification and may be subject to additional eligibility requirements as stated in the specific terms for
    each draw. Prizes are non-transferable, and no cash or alternative prizes will be offered unless specifically stated otherwise. Winners must claim their prize within the timeframe specified in the applicable terms.
  5. Forfeiture of Prize: If the winner refuses to provide consent for the processing and publication of their personal data (as outlined in Section 13), they will forfeit the prize, and no alternative prize will be offered.

13. PUBLICITY AND PRIZE ACCEPTANCE

  1. Prize Collection and Photography: All prizes must be collected from a location determined by the Company, which will be communicated to the winner. The collection location may vary depending on the nature of the prize or the winner’s location, as agreed upon with the winner. Upon collection of the prize, the winner agrees to have their photograph taken at the collection location. This photo, along with the winner’s details, may be published online as part of the Company’s promotional activities. The winner must accept the tag on social media and reshare to their profile. By accepting the prize, the winner consents to this process. Failure to comply with this requirement will result in forfeiture of the prize. Winners of any contests, promotions, or giveaways conducted through the Website must consent to having their name, likeness, and other relevant details published online. This includes having a photograph taken with their
    prize, which may be used by the Company for promotional purposes.
  2. Forfeiture of Prizes: In the event that a prize winner fails to fulfill any obligations as outlined in these Terms and Conditions, or otherwise forfeits their prize (including but not limited to refusal to provide necessary information or consent for publication as required), no alternate or reserve winner will be selected, and the prize will be deemed forfeited.
  3. Nullification of Draw: If a prize winner forfeits their prize as per Clause 13.2, the prize draw associated with that prize will be nullified, and no further claims or entitlements will arise in relation to that draw. The Company reserves the right to cancel the draw and all associated prizes without obligation to select a new winner.
  4. GDPR Compliance for Winners: By accepting the prize, the winner consents to the processing and publication of their personal data, including their photograph, for promotional purposes. If the winner refuses to provide such consent, they will forfeit the prize, and no alternative prize or compensation will be offered

14. THIRD-PARTY LINKS

  1. The Website may contain links to third-party websites that are not owned or controlled by the Company. The Company assumes no responsibility for the content, privacy policies, or practices of any third-party websites. Access to third-party websites is at the User’s own risk

15. LIMITATION OF LIABILITY

  1. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of or related to your use of the Website.
  2. The Company does not guarantee that the Website will be uninterrupted or error-free. You acknowledge that your use of the Website is at your own risk.

16. RIGHT TO REFUSE SERVICE

  1.  The Company reserves the right to refuse service or terminate any account at its sole discretion, including for violation of this Agreement, misuse of the Website, or any conduct deemed harmful to the Company.
  2. The Company may also suspend or delete inactive accounts after a period of 90 days without activity.

17.GOVERNING LAW AND JURISDICTION

  1. This Agreement is governed by and construed in accordance with the laws of Malta. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Malta

REFUND POLICY

Luckycharm Ventures Limited (“we,” “us,” or “our”) is committed to providing clarity on the terms regarding refunds for membership subscriptions. This Refund Policy outlines the conditions under which refunds may be granted

1. RIGHT TO CANCEL WITH IN 14 DAYS

  1. Cancellation Window:
    Under Maltese law, you have the right to cancel your membership within fourteen (14) days of your initial purchase, provided that you have not accessed any membership services. By subscribing, however, you acknowledge and agree that your membership benefits are immediately accessible upon purchase, including full access to member-only content and automatic entry into prize draws conducted during your subscription period.
  2. Cancellation Requests:
    To cancel your membership and request a refund within the 14-day cancellation period, please email contact (at) lussu (dot) mt with your request. Cancellations are processed within 5 business days, and any eligible refunds will be issued following confirmation.
  3. Immediate Access to Benefits:
    By subscribing, you gain immediate access to all membership benefits, including full content access and automatic entry into any prize draws conducted within your subscription period. Because these benefits are provided upon purchase, you acknowledge that your membership is considered fully utilized upon activation. Waiver of Right: Upon activation, your membership provides immediate access to all benefits, including paid content and automatic prize draw entry. Access to these services constitutes full utilization of the membership benefits. Consequently, no refunds will be issued once access has been granted, in accordance with our Terms and Conditions.
  4. Partial Use Waiver:
    Due to the nature of our services, which provide immediate and full access, cancellation after activation is considered a waiver of the right to a refund. Therefore, no refunds will be issued once membership benefits have been accessed or prize draw entry has been granted

2. EXCEPTIONS AND NON REFUNDABLE SITUATIONS

  1. Prize Draw Entry:
    As a monthly member, you are automatically entered into applicable prize draws every week. Entry into any prize draw is considered full utilization of membership benefits. Accordingly, no refunds will be issued if you cancel after being entered into a prize draw.
  2. Access to Paid Content:
    Once your membership grants you access to any paid content, the membership is deemed fully used. Refunds will not be issued for any cancellation after accessing member-only content.
  3. Change of Mind:
    Wedonot issue refunds for a change of mind or for non-use of the membership services once activated

3. REFUND PROCESS

  1. Submitting a Request:

    • Yourfull name,
    • Membership start date, and
    • Reasonfor the refund request.
  2. Processing Time:
    All eligible refund requests will be reviewed within 5 business days of receipt. If approved, refunds will be processed to the original payment method within 3 business days.
  3. Discretionary Refunds:
    Refunds within the 14-day period are at the Company’s discretion and will only be considered if no paid content has been accessed and no prize draws have occurred since the membership activation.
